Terms of Service

These Terms of Service ("Terms") govern your use of the Crowdz crowd-level reporting application and website ("Crowdz", "the Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Who Can Use Crowdz

You must be at least 13 years old to use Crowdz. If you use Crowdz on behalf of a business, you confirm you are authorised to act for that business and that any ABN or business details you provide are accurate.

2. Your Account

• You are responsible for keeping your login credentials secure and for all activity under your account.
• You must provide accurate information when signing up, and keep it up to date.
• We may suspend or close accounts that breach these Terms, submit fraudulent reports, or attempt to abuse or disrupt the Service.

3. Crowd Reports

• Crowd reports must reflect your honest, first-hand observation of the location at the time of reporting.
• Submitting reports for places you are not at, automating reports, or coordinating with others to distort crowd levels is prohibited.
• Location sharing is required to submit a report. Reports are verified against your device's reported position, and we may reject or remove reports that fail verification.
• Crowd levels shown in the app are aggregated estimates provided for general guidance only. We do not guarantee their accuracy, and you should not rely on them for safety-critical decisions.

4. Business Accounts

• Business features (claiming a location, posting discounts, analytics) are available only to verified business accounts. Verification may include ABN checks and manual review.
• You may only claim a location you genuinely operate. Claims are reviewed and may be rejected or revoked.
• Discounts and offers you publish must be genuine, lawful, and honoured as described. You are solely responsible for the offers you post.

5. Acceptable Use

You must not:

• use the Service for any unlawful purpose or in breach of any applicable law;
• post content that is misleading, defamatory, offensive, or infringes anyone's rights;
• attempt to probe, disrupt, overload, reverse engineer, or gain unauthorised access to the Service or its data;
• scrape or bulk-collect data from the Service without our written permission;
• circumvent rate limits, bot protection, or location verification.

6. Privacy and Location Data

Our handling of your personal information, including location data, is described in our Privacy Policy, which forms part of these Terms.

7. Intellectual Property

Crowdz and its design, code, branding, and aggregated data remain our property. Map data is provided by OpenStreetMap contributors and CARTO under their respective licences. You retain ownership of content you submit, but grant us a worldwide, royalty-free licence to store, display, aggregate, and anonymise it for the purpose of operating and improving the Service.

8. Service Availability and Changes

Crowdz is provided "as is" and "as available". We may add, change, or remove features, or suspend the Service, at any time. We will try to give reasonable notice of significant changes where practical.

9. Liability

To the maximum extent permitted by law (including the Australian Consumer Law, whose consumer guarantees are not excluded), we are not liable for indirect or consequential loss arising from your use of the Service, including decisions made in reliance on crowd-level estimates. Where liability cannot be excluded, it is limited to resupplying the Service.

10. Termination

You can stop using Crowdz and delete your account at any time from the app. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination (including 7 and 9) survive.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows the current version. Continuing to use the Service after changes take effect means you accept the updated Terms.
